What is Premises Liability?
Premises liability is a legal concept that holds property owners responsible for accidents and injuries that occur on their property. In Texas, property owners have a duty to keep their premises reasonably safe for visitors. This means that they must take reasonable steps to prevent accidents and injuries from occurring. When they fail to do so, they can be held liable for any resulting harm.
Property owners owe different duties of care to different types of visitors. In Texas, visitors are classified into three categories:
- Invitees: Invitees are individuals who are invited onto the property for the benefit of the property owner. This includes customers at a store or restaurant. Property owners owe the highest duty of care to invitees and must take reasonable steps to ensure that the property is safe.
- Licensees: Licensees are individuals who are invited onto the property for their own benefit. This includes social guests. Property owners owe a slightly lower duty of care to licensees and must warn them of any known hazards.
- Trespassers: Trespassers are individuals who enter the property without permission. Property owners do not owe a duty of care to trespassers, except in certain situations. For example, if the property owner knows that children are likely to trespass on the property, they must take reasonable steps to prevent them from being injured.
It is important to note that property owners are not automatically liable for any accidents or injuries that occur on their property. To recover compensation, you must be able to prove that the property owner was negligent.

Trey is truly an exceptional attorney! After our accident, we felt completely hopeless. The driver at fault lied about their insurance, providing us with a policy that wasn’t even valid at the time of the accident. To make matters worse, their insurance denied our claim, leaving us with no answers and no justice. But Trey went above and beyond to turn things around for us! He immediately conducted a thorough investigation, uncovering that the driver got the insurance after the accident and that the insurance agency was actually owned by the family of the driver at fault. Trey’s dedication and attention to detail were incredible. Trey built a strong case and filed a lawsuit. He not only held the driver accountable but also secured compensation for the damages to our vehicle and medical bills. If it weren’t for Trey’s persistence, we might have given up when the insurance denial came through. But because of him, we found hope and justice when we thought it was out of reach! Thank you, Trey, for everything you’ve done for us. You are truly a lifesaver!- Alexa
